Tax compliance for PPLI comes down to one question: is this policy treated as a life insurance contract where the policyholder, the life assured and the beneficiaries are each tax resident? If it is, local law usually has specific rules for life insurance death benefits and account growth. If it is not, for example because the policyholder's control over the assets goes beyond what local law allows, the policy may be looked through and treated as if the policyholder held the assets directly. That determination is made by the law of the place of tax residence, not by the insurer or the carrier jurisdiction.

The bottom line: three questions to answer before applying

  1. Characterisation: does the jurisdiction where the policyholder, life assured and beneficiaries (and, for a trust, the settlor and beneficiaries) are tax resident treat this policy as a life insurance contract?
  2. Reporting: under CRS and FATCA, which institution reports, on whom, and what figures? Where a trust or company holds the policy, which individuals are identified as controlling persons?
  3. Change: if the family relocates in future (especially to the United States), how will the policy be treated in the new country of residence?

None of the three has a universal answer. Each must be checked jurisdiction by jurisdiction and confirmed in writing by local advisers.

Item Rule Implication for PPLI Source
Estate duty Not levied on deaths on or after 15 Feb 2008 Singapore levies no estate duty on policy value on death; estate or inheritance taxes elsewhere are a separate matter IRAS, 9 Mar 2026
Capital gains Gains from selling property, shares and financial instruments are generally not taxed; they may be taxable if regarded as trading In Singapore, the difference between holding a portfolio directly and through a policy lies mainly elsewhere than capital gains IRAS, 27 Feb 2026
Taxation of trusts Trustee's statutory income taxed at 17% from Year of Assessment 2021; resident beneficiaries taxed at personal rates on their share Where a trust holds the policy, whether account growth is taxable trust income depends on how the policy is characterised IRAS, 2 Feb 2026

The Singapore income tax treatment of death benefits, withdrawals and surrenders is governed by current IRAS rules, which this site does not summarise. Jurisdiction: Singapore. Take professional advice where you are tax resident.

CRS and FATCA: how PPLI is reported

Singapore has exchanged financial account information under the Common Reporting Standard (CRS) since September 2018 (IRAS, 9 Sep 2026). Where PPLI sits under CRS is set by the IRAS CRS e-Tax Guide, Fifth Edition (11 Aug 2026):

Question IRAS position Section
Is the insurer a reporting institution? An insurer that issues Cash Value Insurance Contracts is a Specified Insurance Company, including licensed insurers under the Insurance Act 1966 §5.11.1
Is PPLI a Financial Account? An insurance contract with a cash value is a Cash Value Insurance Contract and a Financial Account; it becomes a Reportable Account only where the holder or a controlling person is resident in a reportable jurisdiction. Cash value is the greater of the surrender amount (before surrender charges and policy loans) and the amount that can be borrowed §5.11.2–5.11.3
What figures are reported? Year-end cash value or surrender value; accounts closed during the year are reported under the closure rules §12.3.6
Who is reported when a trust holds the policy? Where the trust is a Passive NFE, the settlor, trustee, protector (if any) and beneficiaries or classes of beneficiary are all treated as controlling persons; a trust whose trustee is a financial institution is usually an Investment Entity and carries out its own reporting §5.9.2, §5.9.5
Review threshold for pre-existing accounts FATCA allows pre-existing Cash Value Insurance Contracts with balances of US$250,000 or less not to be reviewed; CRS sets no such threshold for pre-existing individual accounts §4.1.3
Timing and amendments Reporting for the previous calendar year by 31 May each year; the amended CRS applies from 1 Jan 2027, with the first exchange expected in September 2028 §2.2–2.3

FATCA: Singapore has a Model 1 Intergovernmental Agreement with the United States. The 2015 Regulations took effect on 18 Mar 2015 and the 2020 Regulations apply from 1 Jan 2021. Reporting institutions must register with IRAS, carry out due diligence on US accounts and file a return or nil return by 31 May each year (IRAS, 11 Aug 2026). Where the policyholder or a controlling person of an entity is a US person, the policy becomes a US account. PPLI issued in Bermuda or Luxembourg is reported by the local insurer under local regulations on the same logic. FATCA and CRS only settle who is reported; they do not determine the tax outcome. Jurisdiction: tax residents of all CRS participating jurisdictions and US persons.

US persons: directly applicable only to US taxpayers and US-situs assets

The rules below bind US citizens, green card holders and US tax residents directly, as well as US-situs assets held by anyone. Non-US readers can use them to understand what to prepare before relocating to the United States.

Definition of a life insurance contract IRC §7702: the contract must be a life insurance contract under applicable law and pass either the cash value accumulation test or both the guideline premium requirements and the cash value corridor; if not, income on the contract is treated as ordinary income (§7702(g)) 26 U.S.C. §7702
Investor control Rev. Rul. 2003-91: the holder may not select or recommend specific investments or communicate with the investment officer about specific investments; where this is met, the holder is not treated as owner of the account assets, whereas otherwise (Rev. Rul. 77-85) the holder is treated as owner IRS, July 2003
Diversification No single investment may exceed 55% of account assets, the top two no more than 70%, the top three no more than 80% and the top four no more than 90%; in a quarter that fails, the contract is not treated as life insurance 26 CFR §1.817-5
Excise tax on foreign insurance Life insurance premiums paid to a foreign insurer are taxed at 1 cent per dollar (1%), reported by the payer on Form 720; claiming a treaty exemption requires disclosure under §6114 IRS Instructions for Form 720, June 2026
FBAR Required where foreign financial accounts together exceed US$10,000 at any point in the year; a policy with a cash value is a financial account; due 15 April of the following year, automatically extended to 15 October IRS, 30 Jul 2026; FinCEN, January 2017
US estate tax for non-resident non-citizens Form 706-NA is required where US-situs assets exceed US$60,000; shares in US companies are US-situs assets; treaties may change the scope IRS, 27 Jun 2026

Legislative direction: on 13 Apr 2026, US Senator Wyden introduced bill S.4279, which would add a new §7702C and deny life insurance tax treatment to qualifying private placement variable policies (govinfo bill text). The bill is so far only a proposal and has not become law; for market background, see Market and regulatory developments. Families preparing to relocate to the United States should obtain a written opinion from a US tax lawyer before they move. Jurisdiction: United States. Notes for Hong Kong and mainland China

Hong Kong. The Revenue (Abolition of Estate Duty) Ordinance 2005 took effect on 11 Feb 2006, and estate duty is not levied on deaths after that date (Hong Kong IRD). Hong Kong's legislation on automatic exchange of financial account information took effect on 30 Jun 2016, and since 1 Jan 2020 there have been 126 reportable jurisdictions (Hong Kong IRD). Jurisdiction: Hong Kong tax residents.

Mainland China. First, CRS: the Administrative Measures on Due Diligence of Tax-Related Information of Non-Residents' Financial Accounts (Announcement No. 14 of 2017 by the State Taxation Administration and five other authorities) took effect on 1 Jul 2017, and insurance contracts with a cash value are accounts subject to due diligence; a Singapore insurer's reporting on mainland tax residents is exchanged to the mainland via IRAS. Second, income tax: under the Individual Income Tax Law (seventh amendment, 31 Aug 2018), Article 1 taxes resident individuals on income from inside and outside China, Article 3 applies a flat 20% rate to interest, dividends, bonuses and income from transfer of property, and Article 4(5) lists "insurance indemnities" as exempt; which of these categories death benefits, withdrawals and surrender gains from an overseas policy fall into must be judged by a mainland tax adviser. Third, timing: resident individuals with foreign income must declare it between 1 March and 30 June of the following year (MOF and SAT Announcement No. 3 of 2020). Fourth, foreign exchange: paying premiums overseas and receiving benefits are subject to mainland foreign exchange rules; this site does not state quotas.

In August 2026, media reported that some mainland policyholders in Hangzhou and Beijing had received notices to declare and pay tax on gains from Hong Kong policies; the 20% rate mentioned came from market sources, and no formal document has been seen (The Paper, 7 Aug 2026). A State Taxation Administration official responded that Chinese tax residents are taxable on worldwide income, that overseas insurance gains fall within the scope of tax, and that "this is not a new policy" (21st Century Business Herald, 10 Aug 2026, as reported by the media). The worldwide-income principle restated by the SAT applies equally to mainland tax residents holding overseas PPLI. However, there is currently no unified formal document on which policy gains are taxable income or how they are calculated; this must be judged case by case by a mainland tax adviser. Jurisdiction: mainland China tax residents. Take professional advice where you are tax resident.

Why this site does not use "tax wrapper" language

PPLI is often called a "tax wrapper" outside Singapore, and a 2024 US Senate Finance Committee report went as far as "tax shelter". This site does not say "no tax payable", "tax-deferred" or "no reporting required", for three reasons. First, a Cash Value Insurance Contract is a CRS Financial Account and must be reported where the holder or a controlling person is resident in a reportable jurisdiction; reporting and tax outcome are two separate matters. Second, "deferral" can only hold where local law treats the policy as a life insurance contract and the policyholder has not crossed the investor-control line, and it can change on relocation. Third, Singapore has no estate duty because it was abolished in 2008, which has nothing to do with the policy. When you see claims of this kind, ask: in which jurisdiction, on what assumptions, and who has given a written opinion?

Which professional opinions are needed, and when

Opinion Given by Timing
Characterisation of the policy where each party is tax resident Local tax adviser Before signing the application
Taxation and identification of reporting parties where a trust or entity holds the policy Singapore tax adviser + adviser where beneficiaries are located Before the ownership structure is settled
The rules for US persons US tax lawyer Before applying; reassess before relocating to the US
Declaration of foreign income and foreign exchange compliance for mainland or Hong Kong residents Mainland / Hong Kong tax adviser Before applying and in each annual filing season
Completing and updating CRS / FATCA self-certifications The policyholder, assisted by the insurer's compliance team At application; update promptly after any change in status

Keep opinions in writing and review them when status or rules change. For ownership structures, see PPLI and trusts and Family offices and VCCs; before signing, work through the Due diligence checklist. Readers who want this interpreted for their own situation can register their needs through the contact details on this site.
